What type of transmission do you have? I have seen some reported software related problems with SMG transmissions on the new 5-series that might account for your problems. Also look on the inside of the driver's door for when your car was built. It's a white sticker (I think) and it'll say month and year, mine says Jan 2004 or Jan 04.
